Grain LNG Bulletin Board - Terms and Conditions of Use

  1. National Grid Grain LNG Limited (“Grain LNG”) provides the bulletin board facility to allow parties to express an interest in buying or selling capacity in the Grain LNG Importation Terminal (the “Terminal”) on the secondary market from or to other users of the Terminal. The bulletin board facility must not be used for any other purpose.
  2. Those posting expressions of interest on the bulletin board facility are solely responsible for the content and accuracy of the posting. Those making postings should not:
    • Post anything which may be considered offensive, abusive, defamatory, obscene, sexual or of a sensitive or political nature;
    • Violate the privacy of others which includes posting private phone numbers, addresses or other personal information without their prior consent on the bulletin board;
    • Falsify the origin or source of any posting
    • Advertise or offer anything other than an expression of interest in buying or selling capacity in the Terminal on the secondary market from or to other users of the Terminal
  3. Grain LNG reserves the right to refuse publication of any notice for any reason with referral back to the party submitting it. Grain LNG reserves the right to withdraw or alter the bulletin board facility or remove or edit the contents of information posted to the bulletin board in whole or part at any time without notice and without giving any reason.
  4. Grain LNG do not represent or make any warranty or endorse in any way the accuracy, reliability or legality of any posting, Grain LNG do not represent or make any warranty or endorse in any way that a party posting an expression of interest is entitled to buy or sell capacity in the Terminal. It is the responsibility of each party to ensure that they have the appropriate arrangements with Grain LNG to utilise any capacity bought or sold following a posting on the bulletin board.
  5. Any reliance you place upon any posting on the bulletin board will be at your sole risk.
  6. Grain LNG is not selling or offering for sale any capacity in the Terminal nor is it acting as agent to any person selling or offering for sale any such capacity in the Terminal. Grain LNG does not recommend or endorse in any way any person posting an expression of interest on the bulletin board, and it shall be for each party to determine whether or not it wishes to contract with any other party.
  7. Grain LNG expressly disclaims in respect of any capacity in the Terminal advertised any and all warranties, express or implied, to the extent permitted by applicable law, including without limitation, warranties of satisfactory quality, merchantability or fitness for any purpose. To the extent permitted by law (save for death or personal injury caused by negligence of Grain LNG) Grain LNG excludes liability (in contract, tort, negligence, statute or otherwise) for any loss, demands, actions, claims or damages whatsoever and howsoever arising including without prejudice to the foregoing direct, indirect, special, incidental or consequential loss or damage and regardless whether such loss or damage was foreseeable.
  8. Grain LNG may review the content of the bulletin board but shall be under no obligations to do so and accepts no responsibility or liability for either doing so or failing to do so.
  9. Any expressions of interest posted on the bulletin board are not legally binding offers and are not capable of being accepted to create legally binding obligations between any party.
