Can the CUSC be amended?
There are provisions within the CUSC (Section 8) which allow CUSC Parties, BSC Parties or 'National Consumer Council' to proposed amendments to the CUSC. Any amendment must better meet the Applicable CUSC Objectives. These can be summarised as follows:
- the efficient discharge by National Grid of the obligations imposed on it by the Act and the Transmission Licence; and
- facilitating effective competition in the generation and supply of electricity and (so far as consistent therewith) facilitating such competition in the sale, distribution and purchase of electricity.
Additional provisions apply where it is proposed to modify the CUSC amendment provisions and generally reference should be made to the Transmission Licence for the full definition of the term.
Any proposed amendment will be assessed as detailed in Section 8 against these criteria.
